LAVA srl sells design products through its online platform.
2. Scope of Application
These Terms and Conditions govern all online sales of products offered by LAVA srl through its website.
They apply to both private customers (B2C) and business customers (B2B), in Italy, the European Union, and extra-EU countries.
By placing an order, the customer confirms acceptance of these Terms and Conditions.
3. Products and Product Information
Product descriptions, images, drawings, and colours shown on the website are provided for illustrative purposes only and are not contractually binding.
Minor variations in colour, texture, finish, or surface appearance may occur between images displayed online and the delivered product due to screen settings, lighting conditions, materials, or production processes. Such variations do not constitute defects.
Some products may be customised or made to order at the customer’s request.
4. Prices
All prices are expressed in Euro (€) and are VAT excluded, unless otherwise stated.
Shipping costs, customs duties, local taxes, or import fees (especially for extra-EU deliveries) are not included in the product price and are borne by the customer.
LAVA srl reserves the right to change prices at any time. Price changes will not affect orders already confirmed.
5. Orders
An order is considered accepted only once the customer receives written confirmation from LAVA srl.
LAVA srl reserves the right to refuse or cancel orders in case of:
● product unavailability
● pricing or description errors
● incomplete or incorrect customer information
6. Payments
Accepted payment methods:
● Credit card
● Bank transfer
For customised or made-to-order products, LAVA srl may require an advance payment.
Orders will be processed only after payment has been received.
7. Shipping and Delivery
Delivery times provided on the website are indicative only and not guaranteed.
The customer is responsible for:
● providing accurate delivery information
● inspecting the package upon delivery
● reporting visible damage immediately to the courier and to LAVA srl
LAVA srl shall not be liable for delays caused by couriers, customs procedures, or force majeure events.
8. Right of Withdrawal and Returns
In accordance with EU consumer regulations, customers purchasing standard (non-customised) products may withdraw from the purchase within 14 days from delivery, without providing any reason.
Return shipping costs are borne by the customer.
The right of withdrawal does not apply to:
● customised or made-to-order products
Returned products must be unused, undamaged, and returned in their original packaging.
9. Warranty
Products sold to consumers (B2C) are covered by a 24-month legal warranty of conformity, in accordance with Italian law.
For sales to business customers (B2B), the legal warranty period is 12 months, unless otherwise agreed in writing.
The warranty does not cover damage resulting from:
● improper or unsafe use
● incorrect handling or storage
● unauthorised modifications
● normal wear and tear
10. Finish, Surfaces, and Floor Protection
LAVA products are finished with high-quality powder coating designed for everyday use. However, the finish is not scratch-proof.
Marks, scratches, wear, or damage caused by:
● friction
● impacts
● dragging or repeated movement
● contact with uneven, abrasive, or delicate flooring
are considered normal wear or improper use and do not constitute manufacturing defects. Such conditions are not covered by the warranty.
The customer is responsible for ensuring that products are used on suitable surfaces. When placing products on delicate floors (such as wood, resin, marble, or polished concrete), the use of protective pads or similar protective elements is strongly recommended to prevent damage to both the product and the floor.
11. Product Use and Safety
Products must be used strictly for their intended purpose.
In particular:
● standing on stools is strictly discouraged
● sitting on stacked stools is strictly discouraged
● stacking stools beyond recommended limits (8–10 units) is not advised
LAVA srl shall not be held liable for damage or injury resulting from improper or unsafe use of its products.
12. Limitation of Liability
To the maximum extent permitted by law, LAVA srl shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the products.
13. Intellectual Property
All content on the website, including designs, images, texts, logos, and trademarks, is the exclusive property of LAVA srl and may not be reproduced, distributed, or used without prior written consent.
14. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
Any dispute arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Court of Reggio Emilia (Italy).
